Chandigarh 23rd August:--- A deputation of Traders Association Sector 17 Chandigarh called on Finance Secretary UT to discuss crucial and burning building byelaws issues in Chandigarh. The delegation consist of President, Kamaljit Singh Panchhi, & General Secretary LC Arora and JPS Kalra. During the Meeting with FS several issues related to the Traders of the City were taken up.
Kamaljit Singh panchhi took up vigorously and assailed the action of Chandigarh Administration to resume SCFs in Sector 22D Chandigarh as they are not authorized by an order of Hon'ble Supreme Court of India dated 8th FEB 2002 in Civil Appeal No. 1605 of 1999. This order allows commercial activities at all floors of all commercial properties (CP category) and the Estate Office is defying these directions and harassing peaceful Owners/Occupiers of the Properties.They should resist from such action and revoke resumption order immediately.
JPS Kalra submitted and pointed out that Misuse charges of Rs.500.00 sq. ft as per notification of 2007. VK Singh, FS was apprised of his office letter No.28/8/3-UTFI (3)6913 dated 23.10.2009 which allows application of all notifications, after date of allotment/auction, with prospective effect only from the date. So the levy of this penalty raised from 10.00 to Rs. 500.00 per Sq. Ft and subsequent demand notices in Crores is not understood and must be withdrawn forthwith.
While Mr. LC Arora took up the matter of non issue of NOCs for Industrial Leasehold Properties for applications submitted as long as 10 months before without assigning any reasons, he requested FS to issue definite directions to the concerned wing to take immediate action. In this case there is expected great loss to the parties who would have got their properties registered at much lesser rates than prevailing today had they been issued NOCs. The Estate Office must clarify this aspect while granting NOCs to all the old applicants.
The Finance Secretary heard the deputation with concern and patience and promised of his positive action, as genuinely desired by us.
