Chandigarh Oct. 06, 2020:- The Haryana High Court has granted a stay order against the FIR filed by Vikas Gupta against OYO and Weddingz.in senior leadership. In a positive move towards decriminalising civil commercial disputes where senior management of organisations are subjected to intentional and wrongful criminalisation without supporting evidence, the court was of the prima facie opinion that the said dispute was civil in nature and that there was no involvement of any criminal offence.
By virtue of the said order all and any other proceedings in the said FIR including the notices issued under 41 A notice (issued by Police) are stayed by the Hon'ble court.
OYO Hotels & Homes had filed Section 482 Quash Petition against the FIR filed by Vikas Gupta, the owner of Casavillaz in Mohali earlier this month, registered before the PS Dera Bassi, Chandigarh. The matter came up for hearing on 28th September 2020. The High Court after hearing OYOs submission as to the facts of the dispute and the pendency of the arbitration petition before the other court, was of the prima facie opinion that the dispute was civil in nature and the FIR was in gross abuse of the process of law. The Court was also unhappy by the manner the police registered the FIR for a civil commercial dispute without verifying the matter on merits. The company had earlier clearly refuted the FIR earlier stating that it was baseless, with a malafide intent to harass OYO and its senior management and to damage the global reputation of not only OYO Hotels & Homes, but also India as a destination for global business and investment.
