PURAB PREMIUM APPARTMENTS JAN-HIT BACHAO COMMITTEE CHALLENGED ILLEGALLY FORMED WELFARE ASSOCIATION WITH APPELLANT AUTHORITY


"PURAB PREMIUM APPARTMENTS JAN-HIT BACHAO COMMITTEE (Regd.) under Society Act 1860" LOGGER HEADS WITH GMADA on illegally constituting the Purab Premium Apartment Welfare association under the rule 8 of Punjab Ownership Act 1995 (commonly called as POA act) as all 05 members is of GMADA officials (including Chief Administrator: GMADA, Estate Officer (Housing) Mahesh Bansal & ACA: GMADA) and 02 names /designation name is even missing, instead of allottees'/apartments owners' in grave violation of the POA act.

So President Gobind Ram Seth & General Secretary Rahul Sharma has filed Appeal under section 33 (2) of the Punjab Apartment Ownership Act, 1995 against the decision of the Competent Authority – cum – Sub – Divisional Magistrate, Mohali for constituting the formation of the unlawful Welfare Association under the name and style Purab Premium Apartments Welfare Association on Sept. 29, 2020, Sector – 88 Mohali with the prayer to disband the said illegal & unlawful association and prevent/stop such General body meeting called by GMADA on NOV. 18, 2020 in Community Centre of PURAB SOCIETY

The decision and the act of the Competent Authority – cum – Sub – Divisional Magistrate are unlawful and bad. The Purab Prem. Apartments project is yet not completed despite possession was handed over in July 2016. Till date even "Car Parking" is not handed over to allottees' besides GYM, Swimming Pool, Yoga and meditation hall is not functional apart from the huge deviations from the promised specifications and actually & factually given as per the GMADA brochure. Huge numbers of allottees have even taken money back after litigations with GMADA and over 150-165 litigations are still pending in RERA & National Consumer Court.

The competent authority cum SDM can only interfere under the provision of section 23 (1) if the Association is not performing its functions in a lawful manner or in the interest of its members.  The Competent Authority in such cases can issue the directions after the occupancy certificate is given after completion of the said housing project.
